By accessing our website, requesting quotations, approving drawings/specifications, placing an order, making payment, accepting delivery, permitting access to site, or allowing delivery/assembly to proceed, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions together with our Privacy Policy, Terms of Service, quotations, invoices, and related policies.

⚖️ These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008 (“CPA”).

🌲 1️⃣ Timber, Manufacturing & Product Nature

Our products are manufactured using real timber and industrial manufacturing processes.

The customer acknowledges and accepts that:

✔️ Timber is a natural product and not laboratory manufactured
✔️ Variations in grain, knots, colour, texture, markings, resin, movement, bowing, expansion, contraction, and minor imperfections are natural and expected
✔️ Slight manufacturing tolerances, joins, sanding marks, filling, machining marks, and cosmetic variations may occur
✔️ Product photos, renders, and examples displayed online are illustrative only and final products may vary slightly

➡️ These are normal characteristics of timber products and do not constitute defects.

Garage Guys reserves the right to make reasonable manufacturing, hardware, material, supplier, or design adjustments where necessary.

📏 2️⃣ Measurements, Drawings & Specifications

All products are manufactured strictly according to the measurements, layouts, drawings, specifications, and instructions supplied or approved by the customer and/or their appointed representative.

The customer is solely responsible for ensuring:

✔️ Measurements are accurate
✔️ Products will fit into the intended space
✔️ Access routes are suitable
✔️ Walls, floors, ceilings, and mounting surfaces are structurally suitable
✔️ The site is level, safe, clear, and accessible
✔️ Any body corporate, landlord, estate, municipal, or third-party approvals have been obtained where required

➡️ Once approved, all drawings/specifications are deemed final.

If incorrect, omitted, inaccessible, obstructed, changed, unsafe, or inaccurate information is supplied, any redesigns, remanufacturing, delays, return visits, collections, redeliveries, labour, storage, modifications, or reassembly may be requoted separately and charged accordingly.

🚚 3️⃣ Delivery, Assembly & Site Conditions

Garage Guys provides:

✔️ Delivery
✔️ Standard assembly/setup services

Unless expressly agreed in writing, we do NOT perform:

❌ On-site cutting
❌ Carpentry modifications
❌ Structural alterations
❌ Electrical work
❌ Plumbing work
❌ Engineering or building work
❌ Site preparation or repairs
❌ Waterproofing or sealing work
❌ Moving existing furniture/appliances

Our assembly teams work strictly according to approved plans and supplied materials.

If unforeseen obstructions, hidden services, uneven surfaces, restricted access, unsafe conditions, pets, children, weather conditions, body corporate restrictions, parking/access limitations, or site constraints are encountered, delivery or assembly may be delayed, suspended, cancelled, or requoted.

✔️ Insurance compliance

…while reducing unnecessary risk, disruption, dust, noise, and potential damage.

Customers are responsible for ensuring safe and reasonable access to the property and work area.

⚠️ 4️⃣ Liability, Risk & Indemnity

The customer acknowledges that delivery, lifting, carrying, transporting, moving, handling, loading, offloading, mounting, and assembly of large timber products involve inherent operational risks.

To the fullest extent permitted under South African law, Garage Guys, its directors, employees, contractors, suppliers, agents, and representatives shall not be liable for:

❌ Indirect or consequential damages
❌ Delays or operational interruptions
❌ Loss of income, profits, business, or opportunity
❌ Damage to walls, floors, ceilings, paint, tiles, paving, carpets, fittings, plumbing, electrical systems, waterproofing, wiring, furniture, appliances, vehicles, landscaping, driveways, gates, pathways, or surrounding property
❌ Scratches, chips, dents, cracks, markings, scuffs, or cosmetic damage arising from access limitations or assembly conditions
❌ Hidden pipes, conduits, wiring, waterproofing, drains, or latent structural defects not visible during assembly
❌ Structural failures relating to walls, floors, ceilings, mounting surfaces, or building movement
❌ Damage caused by moisture, humidity, weather, environmental exposure, sunlight, corrosion, termites, pests, or natural timber movement over time
❌ Injury, loss, theft, or damages arising from unsafe, obstructed, uneven, unsuitable, or restricted sites
❌ Damage resulting from customer-approved mounting positions, layouts, or instructions
❌ Damages arising from misuse, overloading, incorrect assembly by third parties, or modifications performed after delivery

➡️ By proceeding with delivery and/or assembly, the customer expressly indemnifies and holds harmless Garage Guys and its directors, employees, contractors, suppliers, and representatives against any claims, losses, liabilities, legal costs, expenses, or damages arising directly or indirectly from delivery, handling, access, transport, assembly, installation, site conditions, approved specifications, or use of the products supplied.

Nothing herein excludes liability where prohibited by South African law, including liability arising from gross negligence or wilful misconduct where legally applicable.

🧱 5️⃣ Product Use, Weight Limits & Safety

Our shelving is modular, strong, and designed for practical storage 💪

However:

✔️ Shelves must be assembled correctly
✔️ Weight must be distributed evenly
✔️ Units should be secured/anchored where necessary
✔️ Products must be used responsibly and within intended limits

Garage Guys shall not be liable for damages, collapse, injury, or failure arising from:

❌ Overloading
❌ Uneven loading
❌ Incorrect assembly by third parties
❌ Misuse or abuse
❌ Outdoor exposure unless specified
❌ Water or moisture damage
❌ Failure to secure units properly
❌ Structural movement of buildings or walls
❌ Third-party alterations or modifications

➡️ Load ratings are guideline estimates only and assume proper installation and intended use conditions.

Customers are responsible for ongoing inspection, maintenance, tightening, anchoring, and safe use of products after installation.

📦 6️⃣ Delivery, Courier & Risk Transfer

Risk in goods passes to the customer immediately upon:

✔️ Delivery
✔️ Collection
✔️ Offloading at site
✔️ Placement on premises

Please inspect all goods immediately upon receipt.

📸 Any shortages, transit damages, visible defects, or discrepancies must be reported within 48 hours together with supporting photographs and documentation.

Claims without sufficient supporting evidence may unfortunately not be processed.

Garage Guys shall not be liable for:

❌ Courier delays
❌ Third-party transport issues
❌ Supplier shortages
❌ Weather disruptions
❌ Strikes
❌ Load shedding
❌ Force majeure events beyond reasonable control

🔁 7️⃣ Returns, Refunds & Custom Orders

Due to the customised and modular nature of our products, the following are generally non-returnable and non-refundable unless required by law:

❌ Custom-made products
❌ Special-order items
❌ Modified or treated products
❌ Assembled goods
❌ Non-standard configurations
❌ Used or damaged products
❌ Products without original packaging

Approved returns may be subject to:

💳 Handling fees
🚚 Collection/delivery fees
🛠️ Labour/refurbishment fees
📦 Restocking fees

Delivery and assembly fees are non-refundable.

Where applicable under the CPA, remedies may include:

✔️ Repair
✔️ Replacement
✔️ Store credit
✔️ Refund

…subject to inspection and applicable legislation.

💳 8️⃣ Payments & Ownership

We accept:

💳 Card Payments
🏦 EFT/Bank Transfer

Goods will only be released once cleared funds reflect in our bank account.

All goods remain the property of Garage Guys until paid in full.

By making payment, the customer expressly confirms and acknowledges that they:

✔️ Accept these Terms & Conditions
✔️ Accept our Terms of Service and Privacy Policy
✔️ Accept all approved measurements/specifications
✔️ Accept natural timber characteristics and manufacturing tolerances
✔️ Accept the applicable liability limitations and indemnities contained herein

🔒 9️⃣ Privacy & POPIA

We respect your privacy and process personal information in accordance with the Protection of Personal Information Act (“POPIA”).

Information supplied to us may be used for:

✔️ Quotations
✔️ Orders
✔️ Deliveries
✔️ Customer communication
✔️ Service improvement
✔️ Legal or operational compliance

While we take reasonable security precautions, no online system is completely risk-free.

You may not:

❌ Misuse this website
❌ Attempt to interfere with website functionality
❌ Copy content without permission
❌ Use automated tools, scraping software, or bots without consent
❌ Publish defamatory, unlawful, or harmful material through our website systems

Garage Guys reserves the right to suspend or terminate website access where misuse occurs.

Nothing contained herein is intended to unlawfully limit any rights afforded to consumers under the Consumer Protection Act, 68 of 2008.

Where legally required, Garage Guys will provide remedies reasonably required under applicable South African law.
